WebWatch (ABN 40 670 532 871) provides website uptime monitoring services through the website webwatch.com.au. By creating an account or using our services, you agree to these Terms of Service.
WebWatch monitors the availability of websites, APIs, and services by performing periodic checks from our infrastructure. When an issue is detected, we notify you via your configured alert channels (email, webhook).
The service is provided on a best-effort basis. WebWatch does not guarantee 100% uptime of the monitoring service itself, nor do we guarantee detection of every outage. Our monitoring checks are subject to the intervals and limits of your current plan.
All plans, including the Free plan, permit commercial use. You may use WebWatch to monitor business websites, client projects, SaaS applications, and any other commercial endeavour without restriction.
Plan limits (number of monitors, check intervals) are enforced automatically. If you exceed your plan's monitor limit, you will need to upgrade or remove monitors before adding new ones.
Paid subscriptions are processed by LemonSqueezy (Lemon Squeezy, LLC), which acts as the Merchant of Record for all transactions. All prices are displayed in Australian Dollars (AUD) and include applicable taxes as handled by LemonSqueezy.
Subscriptions renew monthly and can be cancelled at any time through the LemonSqueezy billing portal accessible from your Settings page. Cancellation takes effect at the end of your current billing period.
Refunds are handled in accordance with Australian Consumer Law. If the service has a major failure, you are entitled to cancel and receive a refund for the unused portion of your subscription. For minor issues, we will work to resolve the problem within a reasonable time.
If you downgrade to a plan with a lower monitor limit and you currently have more monitors than your new plan allows, excess monitors will be paused (set to inactive). No monitors will be deleted. You can reactivate them by upgrading your plan.
You agree not to:
We reserve the right to suspend or terminate accounts that violate these terms without notice.
To the maximum extent permitted by law, WebWatch's liability for any claim arising from or related to the service is limited to the amount you have paid for the service in the 12 months preceding the claim.
WebWatch is not liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of revenue, business interruption, or data loss arising from missed or delayed monitoring alerts.
Nothing in these terms excludes or limits consumer guarantees under the Australian Consumer Law that cannot be excluded by law.
Your use of WebWatch is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.
You may delete your account at any time by contacting us. We may terminate or suspend your account if you breach these terms. Upon termination, your monitoring data will be deleted within 30 days.
We may update these terms from time to time. Material changes will be communicated via the email address associated with your account. Continued use of the service after changes constitutes acceptance.
These terms are governed by the laws of New South Wales, Australia. Any disputes will be resolved in the courts of New South Wales.
